2) YOUR ACCOUNT

To place an order on the thortful site you must provide an email address, either by selecting the “Continue as Guest” option and entering it when prompted, or by signing up for an account via email address or via Facebook, Apple account or Google account giving your name and email address. Your details must be complete, correct and true.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party.

We have the right to disable or terminate your account, guest access, user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have: (a) failed to comply with any of the provisions of these Customer Terms; (b) violated any other applicable regulations, guidelines or laws; (c) if your conduct is harmful to other thortful users, our services or any third parties; or (d) if you have not accessed your account for a prolonged period of time.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at [email protected].

You have the right to close your account at any time by contacting us at [email protected]. If you exercise this right you will no longer be able to log into your account from the thortful sites. Data associated with your account may be retained by us in accordance with our privacy notice.

3) ORDER PROCESS

Orders are placed via the thortful site when you press the confirm order button at the end of the checkout process and receive an order number. There are instructions on site which will guide you through the order process.

a) Timing of your order

As a part of the checkout process you will be able to select the preferred delivery date for your order delivery. Whilst we will endeavour to meet this delivery date, we cannot guarantee that delivery will occur on this date.

b) Declined orders

We may decline or cancel your order at any point prior to delivery for any reason including without limitation where the product you’ve ordered is unavailable, where we are unable to obtain authorisation for your payment or where there is a pricing or product description error. If we decline or cancel your order after payment has been taken, we will refund you via the payment method used to place the order.

c) Alcohol

If you are ordering an alcoholic product you will be required to verify that you and the recipient of the gift are aged 18 or over. It is illegal to purchase alcohol if you are underage or to purchase alcohol for another person who is underage. You must not click the confirm order button to purchase an alcoholic product if you or the recipient of the gift is aged under 18. We reserve the right not to supply alcoholic products where we reasonably believe that you are below the relevant minimum age. We reserve the right to request proof of age identification at the point of delivery.

4) PRICES, PAYMENT AND REFERRAL CODES

All prices are exclusive of delivery charges unless otherwise stated. All prices include VAT. VAT invoices can be issued on request for orders of 5 cards or more, by emailing us at [email protected] We will issue the invoice within 7 working days.

We accept American Express, Visa and MasterCard credit and debit cards as well as PayPal, Apple Pay (for iOS app) and Google Pay (for Android app). In order to offer the best security, all of our credit and debit card payments are processed securely by our payment processor Stripe or, if selected as a payment option, PayPal.

When you create an account you will have the option of having your card details stored securely by Stripe so that you can check out on future visits without re-entering your card details. Credit and debit card details are processed by Stripe and are not shared with us. Card details saved to one account can’t be saved to another.

On occasion, Stripe will send the issuing bank a request for a minimal payment (usually £1) for authorisation to verify that the card is issued, and the bank will allow it to be authorised. This is a security measure from Stripe, to ensure that your card is chargeable, and will have no effect upon the overall price you pay for any products you purchase from the thortful sites. Regardless of whether or not the authorisation is declined, the authorisation request is reversed immediately. However, even if the bank declines the authorisation, some people may still see an authorisation for that minimal amount on their credit card statement. This is not a charge. It will be automatically removed from your statement by your bank within a few weeks, if not sooner.

Promotional Codes

From time to time we may issue promotional codes which can be redeemed against certain purchases. Each promotion will have its own terms of use which will apply in addition to the terms set out here. Promotional codes will have expiry dates and no credit or cash alternative will be offered if you do not use a promotional code before its expiry date.

Where a refund is given in relation to a product purchased using a promotional code, the refund will be limited to the promotional price paid and not the full value of the product. The promotional discount will apply to the original purchase only, and is not valid for any subsequent exchanges or purchases.

Terms of use for promotional codes may be modified at our discretion, without prior notice.

In case of abuse of promotional codes, including but not limited to, publication on online discount codes sites, mass mailing etc., we reserve the right, at our absolute discretion, to expire or revoke promotional codes, or to temporarily remove the ability to redeem promotional codes on the thortful sites.

Please note we reserve the right to cancel or suspend any of our promotional campaigns at any time.

5) CHANGING AND CANCELLING YOUR ORDER

a) Changes to your order

It is important that you check your order carefully before pressing the confirm order button because you may not be able to change or cancel your order once it has been placed (other than in limited circumstances).

If you have made a mistake and wish to change your order, please contact us as soon as possible at [email protected], using the email your account is registered under and quoting the order confirmation number.

If you’ve made a mistake with an order we’ll always do our best to make changes you if you contact us within 30 minutes of placing your order, but if you contact us outside of the hours of our core hours of operation (being 9am – 5.30pm on business days, subject to alteration from time to time) or during periods of peak demand we may not pick up your request until after your order has been printed or dispatched. At which point no changes can be made.

b) Made to order, personalised, bespoke and perishable products

The majority of our products are made to order, personalised or bespoke to you. This means you will be unable to cancel your order once it has been placed. Made to order, bespoke and personalised products include cards, chocolate cards, socks cards and other gift cards. We are also unable to accept cancellations of flower orders due to their perishable nature. This doesn't affect your statutory rights if products are faulty or not as described.

c) Other products

Orders for products which are not made to order, bespoke, personalised or perishable, such as alcohol, soft toys and chocolates (excluding chocolate cards) may be cancelled in accordance with the Consumer Contracts Regulations 2013 which give you the right to cancel your order if you so wish, provided you exercise your right no longer than 14 days after the day on which the products are received.

If you wish to exercise your right of cancellation, you (or the gift recipient, where applicable) must not open the products or break any safety seals and must take reasonable care of the products until they are returned to us.

To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address. You can request a printable cancellation form by emailing us at [email protected] or by writing to us at.

If you decide to cancel, you should return the products to us (or procure that the gift recipient returns the products to us) at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to products to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

We may make a deduction from the reimbursement for loss in value of any products supplied, if the loss is the result of unnecessary handling by you or the gift recipient. We will make the reimbursement no later than 14 days after the day we receive the products back from you however please be aware that banks might take an additional 2-14 days to refund the amount to your card.

6) DELIVERY

a) Cards, subscriptions, Card Packs and Card Gifts

Cards, subscriptions, Card Gifts and Card Packs can be delivered via Royal Mail First Class post, Royal Mail Second Class post, Royal Mail Tracked 24, Royal Mail Tracked 48 (or such other delivery service as we select). Whilst we will endeavour to deliver your order by your chosen delivery date, Royal Mail First Class post is not a guaranteed one-day delivery service, so we cannot guarantee the exact delivery date.

Royal Mail Tracked 24 is a higher-priced service which offers next-day delivery, Mon-Sun. Royal Mail aims to deliver Tracked 24 items the next day, but does not guarantee it.

Royal Mail Tracked 48 is a service which offers tracked delivery within two days, Mon-Sat. Royal Mail aims to deliver Tracked 48 items within two days, but does not guarantee it.

We cannot be held responsible if an item arrives late due to any delays by the postal service or any other circumstances outside of our control.

b) Flowers, alcohol, and other gifts (excluding Card Gifts and subscriptions)

Flowers can be dispatched via Amazon Shipping providing the delivery address is within the post codes that a next-day delivery is available.

Flower, alcohol and other gift orders (exc. Card Gifts and subscriptions) can be dispatched via DPD’s next day service (or such other courier service as we select). You will receive a notification email when your order has been dispatched and you will be able to track your order via DPD’s website or mobile app using the tracking number provided. For alcohol orders, we reserve the right to require proof of age upon delivery. During the order process you will have the option of providing your phone number to enable you to receive updates regarding your delivery and to ensure your driver knows your delivery preferences. If you provide the phone number of the gift recipient, please note that order related information may be shared with them prior to the gift being delivered.

Although we will always try our best to ensure punctual delivery, thortful cannot be held responsible if an item arrives late due to any circumstances impacting the availability of the DPD courier service or any other circumstances outside of our control.

In the event that DPD attempt to deliver the package but there is no one present to sign for it and no designated safe place for delivery, DPD will leave a calling card and send an email or SMS to rearrange the delivery. They will also provide proof of the attempted delivery which may be in the form of a photograph and/or GPS location at the attempted delivery time. However, DPD may choose to leave a delivery with a neighbour, but will still leave a calling card and send an email or SMS with this update.

For flower orders, DPD will handle the package for a total of 3 days before the parcel is discarded. This is due to the perishable nature of flowers, and risk to the quality of flowers after 3 days. If delivery is attempted on two separate occasions, or if the 3 days elapse without effort to reschedule/rearrange delivery by you or the recipient, we will deem the delivery to have failed.

For alcohol and other gift order, If delivery is attempted by DPD on two separate occasions without effort to reschedule/rearrange delivery by you or the recipient, we will deem the delivery to have failed. If we deem a delivery to have failed, we will not be responsible for the cost of another delivery attempt and we will not be required to provide a replacement.

Alcohol and other gift orders (exc. Card Gifts, Flowers and subscriptions) can also be dispatched via Royal Mail Tracked 24 (or such other courier service as we select).

You will receive a notification email when your order has been dispatched and you will be able to track your order via Royal Mail’s website or mobile app using the tracking number provided. For alcohol orders, we reserve the right to require proof of age upon delivery.

Although we will always try our best to ensure punctual delivery, thortful cannot be held responsible if an item arrives late due to any circumstances impacting the availability of The Royal Mail Tracked 24 service or any other circumstances outside of our control.

d) Non-delivery

We will send an email notification when your order has been dispatched but we are unable to provide delivery notifications or obtain proof of delivery.

In the event of non-delivery (an order/item not having arrived 3 working days after its dispatch date other than as a result of you or the recipient failing to accept delivery), please contact us at [email protected]. In this instance we will take the following steps, depending on the nature of the items ordered:

• Cards: offer to reprint and resend your order, or alternatively to apply a free card credit to your account or refund the price paid for the card where you have a valid reason for declining a reprint.
• Flowers and other items: offer to replace your order, or alternatively refund the price paid for the order where you have a valid reason for declining a replacement.

It is your responsibility to contact us within 14 days of the estimated delivery date in order to claim a reprint, replacement or refund. Failure to do so may result in the lapse of these rights.

We are unable to provide replacements or refunds for any deliveries sent to the wrong location where an address is entered incorrectly on checkout.

7) REFUNDS AND RETURNS

Other than as set out above in relation to cancellation and non-delivery, we will only accept returns and issue replacement products or refunds in the following circumstances.

a) Damage

We maintain strict quality control measures when printing, packing and dispatching orders but sometimes damage can occur. If products are delivered damaged or with printing faults, please contact us as soon as possible (and in any event within 30 days) quoting your order number, so that we can arrange a free replacement at our next available delivery date or a refund where you have a valid reason for declining a replacement.

With flower orders a reasonable amount of compromised quality may be experienced as a result of transit time, however every effort is made to ensure that this is minimal. For information regarding the quality and nature of the flowers upon arrival, please refer to the bouquet specific booklet provided with the order. Degradation in quality as a result of extended transit time resulting from rescheduled or re-attempted delivery will not entitle you to a replacement or refund.

We may require, at our sole discretion, that you email photos of the damaged / faulty products in order to be eligible for a replacement or refund, and we may ask for you to return the damaged / faulty products to us.

b) Design Errors

Card designs are printed as the customer sees them when placing an order. Any subsequent changes to the design will not affect an order after it has been placed. We will not be liable for any spelling or artistic mistake on the design itself, if you have not noticed this before ordering. We may, however, at our sole discretion, offer to replace the design with a corrected version dependent on the creator’s co-operation in amending it and provided we receive from you a picture of the card showing the design error. This will be done as soon as we are able to facilitate it but cannot be guaranteed within a specific timeframe.

You must ensure that you check your order carefully before pressing the confirm order button at the end of the checkout process. We are unable to provide replacements or refunds for products due to your own spelling mistakes or other content errors which are not identified by you during the checkout process.

c) Incorrect products

We follow rigorous packing processes but occasionally as a result of human or machine error you may receive an incorrect product in your order. If the products received are incorrect, please contact us quoting your order number and the number on the back/spine of the card (where applicable), so that we can arrange a free replacement at our next available delivery date or a refund where you have a valid reason for declining a replacement.

We may from time to time substitute flowers from your ordered bouquet for alternative flowers of a similar price and quality. This substitution will not amount to an incorrect product and will not entitle you to a replacement or refund. Should you feel that your flower delivery does not reflect what you have ordered, please contact us quoting your order number and the number on the card which accompanied the flowers, so that we can arrange a free replacement at our next available delivery date or a refund where you have a valid reason for declining a replacement.

We may ask you to email photos of the incorrect products in order for use to verify that you are eligible for a replacement or refund, and we may ask for you to return the incorrect products to us.

d) Orders Returned to Us by the recipient

We provide a return address which is printed on all orders we ship. In the event that the recipient returns a product to us (for example, if it has been sent to an incorrect address or the recipient wishes to decline a gift), we will endeavour to contact you with a courtesy email to notify you of the return and we will keep such returned orders (excluding flowers) for a total of 30 days. We will not be responsible for orders which are returned to us and you will not be entitled to a replacement or refund if the recipient returns a product to us. It is your responsibility to ensure that a full, correct and clear delivery address is added at the checkout.

e) Refunds

We generally offer free replacements or credits to your thortful account in the relation to damaged, faulty or incorrect products. However, if a replacement is not possible or you have a genuine reason for declining a replacement, we may offer a refund. If you do receive a refund, we will refund you the total amount you paid for the product(s) plus any delivery charges you have paid, within 7 days of the day on which you provide us with the information requested (including where applicable evidence that the product(s) are damaged, faulty or incorrect). You will receive an email confirming your refund has been processed, however please be aware that banks might take an additional 2-14 days to refund the amount to your card. Please note, it is not our policy to offer both a refund and a replacement/card credit.

8) PRIVACY AND COOKIES

When creating an account or placing an order with thortful, you are asked to provide a contact email and will have the option to decide whether you would like to receive marketing communications from us. You can opt-out of receiving marketing communications from us by following the unsubscribe instructions included in all of our marketing communications, or by getting in touch with us at [email protected].

If you opt-out of receiving marketing communications from us, we may still use your email address to contact you with order confirmations, dispatch notices and other information about your orders.

9) GENERAL TERMS

a) Changes To These Terms

These Customer Terms may be changed or updated by us at any time without notice. We recommend that you check these Customer Terms periodically for any updates we might make from time to time, as they will be binding on you.

b) Changes to the thortful website and mobile applications

We may update the thortful sites from time to time, and may change the content at any time. If the need arises, we may suspend access to the thortful sites, or close them indefinitely. While we endeavour to keep the content on the thortful sites up to date, any of the material on the thortful sites may be out of date at any given time, and we are under no obligation to update such material.

c) Availability

We do not guarantee that the thortful sites, or any content on them, will always be available or be uninterrupted or be free from errors or omissions. We may suspend, withdraw, discontinue or change all or any part of the thortful sites without notice. We will not be liable to you if for any reason the thortful sites or any part of them is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the thortful sites. You are also responsible for ensuring that all persons who access the thortful site through your internet connection or from your devices are aware of these Customer Terms and other applicable terms and conditions, and that they comply with them.

We may limit the availability of the thortful sites or any service or product described on the sites to any person or geographic area at any time.

d) No reliance on information

The content on the thortful sites is provided for general information only. It is not intended to amount to advice on which you should rely.

e) Intellectual property rights

We are the owner or the licensee of all intellectual property rights in the thortful sites and the content. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may only use the thortful sites for lawful purposes and you may not use it in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of the thortful sites.

You must not, without our prior written consent, copy, reproduce, crawl, frame, republish, download, print, post, distribute, re-post, broadcast, record, transmit, edit, communicate to the public, link to, deep-link into, or distribute in any way the web pages or materials on the thortful sites other than solely for your own personal use.

Our status, and that of any identified creators, as the authors of material on the thortful sites must always be acknowledged. You must not use the thortful sites or any part of the content for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy, download or otherwise use any part of the thortful sites in breach of these terms of use, your right to use the thortful sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

IP Infringement Policy We respect the intellectual property rights of others and we ask our customers and creators to do the same. Our creators are responsible for the content which they upload to the thortful sites and for ensuring that they have the necessary rights to use and sell that content. If you are aware that any of your intellectual property rights have been infringed by any product offered for sale on the thortful sites, please contact us via email ([email protected]) and provide us with the following information:

• identification of the copyrighted work claimed to have been infringed;
• identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
• your contact information, including your address, telephone number, and an email address;
• a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law; and
• a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

Where we receive notice of an infringing product we will liaise with the relevant creator (which may include passing on the information you provide) to ensure that the infringing product is removed from sale.

f) User Conduct

You must not use the thortful sites to upload, distribute or share any prohibited content including but not limited to the following:

• copyrighted material used without the express permission of the owner;
• material that violates the rights of others;
• material that contains viruses, worms, trojan horses or other forms of corruptive code, or any other content that may compromise the thortful sites;
• material that advocates illegal activity;
• content we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate;
• material that, in any way, is harmful to minors; or
• material that provides a link to any of the above.

We have the sole discretion to determine whether content is prohibited content, and we may examine content submitted to the thortful sites from time to time. We do not monitor or control the content posted to the thortful sites and we do not take responsibility for such content. However, we may delete, move, and edit content for any reason, at any time, without notice.

g) Our liability

Our liability in connection with any faulty or defective card or other product purchased through the thortful sites and in connection with any non-delivery is limited to issuing a replacement or refund as set out above.

Whilst we take reasonable care in relation to the thortful sites, the material displayed on the thortful sites is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Except where required by law, we accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable or for any and all and damages, losses or causes of action arising, by reason of or in connection with your use of the thortful sites.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes our liability for death or personal injury arising from our negligence, and our liability for fraudulent misrepresentation or misrepresentation.

h) Viruses, hacking and other offences

You must not misuse the thortful sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the thortful sites, the server on which the thortful sites is stored or any server, computer or database connected to the thortful sites. You must not attack the thortful sites via a denial-of-service attack or a distributed denial-of service attack. In the event of a breach of these obligations, your right to use the thortful sites will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the thortful sites or to your downloading of any material posted on it, or on any website linked to it.

i) Linking to the thortful sites

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you. The thortful sites must not be framed on any other site, nor may you create a link to any part of the thortful sites other than the home page. We reserve the right to withdraw linking permission without notice.

j) Links from the thortful sites

Where the thortful sites contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

k) Jurisdiction and applicable law

If you are a consumer, these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Terms & Conditions

These terms set out the Terms and Conditions which apply to the thortful loyalty programme (“ rewardful”) following its launch on 16th October 2025 (the “Launch Date”). Your participation in the thortful Loyalty Programme (“rewardful”) means that you accept and agree to abide by these Terms. References to 'you' mean you as a participator in rewardful.

References to 'we', 'us', 'our' or 'thortful' are to the provider of the thortful Loyalty Programme (“rewardful”), which is THORTFUL LIMITED.

We are registered in England and Wales under company number 09524310, and we have our registered office at Dean Bradley House, 52 Horseferry Road, London, England, SW1P 2AF.

a) Overview

1. The thortful Loyalty Programme (“rewardful”) rewards eligible customers with the value of a free standard A5 card after collecting 5 stamps from qualifying purchases.
2. These T&Cs apply in addition to our Website Terms of Use and Privacy Policy. If there is a conflict, the Website Terms of Use will take precedence over these thortful Loyalty Programme (“rewardful”) Terms and Conditions.
3. Your statutory rights are not affected by these T&Cs.

b) Eligibility & Accounts

1. “rewardful” is open to customers with a valid thortful account (“Account”) and who are aged 16 years or over.
2. Personal use only. Business/reseller accounts, as well as bulk/commercial purchases, are excluded.
3. Stamps and reward codes are non-transferable, have no cash value, and may only be used by the account that earned them. Stamps themselves cannot be sold, transferred, or pooled across accounts.
4. Single account per person. Creating multiple accounts or otherwise attempting to game the _ Programme is prohibited.
5. You are responsible for keeping your account details (including email address) up to date. We are not responsible if reward codes are sent to an out-of-date or incorrect email address supplied by you.
6. Opting out of Loyalty Communications or “rewardful” may take up to 72 hours to be processed.
7. We can take any action we deem appropriate in our sole discretion, including closing or suspending your rewardful and/or thortful account and/or revoking any rewardful benefits accrued if we have reason to believe that you are abusing rewardful in any way, and/or are in breach of these terms.

c). Joining & rewardful Communications

1. To join, create a thortful account.
2. You must remain opted-in to Loyalty Communications “rewardful” (e.g., stamp progress, reward codes, rewardful updates) so we can operate the thortful Loyalty Programme (“rewardful”) for you. You can opt out at any time, but please refer to clause 11 (Leaving/Unsubscribing) for details.
3. Marketing emails (general offers/news/reminders) are separate and optional. Your consent choices for marketing do not affect your ability to receive Loyalty Communications “rewardful”.

d). Earning Stamps

1. How stamps are earned.

   1 stamp per qualifying card purchased when you’re logged in to your account. Qualifying card types: standard A5 cards, A4 cards, Photo cards, Face Swap cards, cards bought alongside gifts, and card gifts. Each eligible card = 1 stamp unless purchased as part of a pack. Card packs (8-pack or 16-pack) earn 1 stamp per pack (not per card). Postcards are excluded from earning stamps. See clause 5 for additional rules applying to new and returning customers.

2. section Excluded purchases.

   Unless stated otherwise, stamps are not earned on the purchase of gift cards, e-gift vouchers, delivery charges, or orders where a free card or 100% discount code has been applied. Loyalty Reward “rewardful” codes do count towards stamps.

3. Qualifying purchase means a card order that is successfully processed, not cancelled, and not refunded.
4. Discounts & promotions.

   You’ll still earn a stamp when you place an order using a discount code or promotion. The only exceptions are that free card or 100% discount codes do not give you a stamp, while Loyalty Reward “rewardful” codes do give you a stamp. Where we have indicated a time applies to an offer (e.g. a sale event, competition, etc.), the time zone will be designated as GMT / BST, unless otherwise indicated in the offer.

5. Guest checkout does not earn stamps. You must be logged in to an account that is also opted in to Loyalty Communications “rewardful” to accrue loyalty stamps.
6. Gifting.

   Cards sent to someone else still earn stamps if the purchase is made while logged in to your account and opted into Loyalty Communications “rewardful”.

7. Multiple items/orders.

   Stamps accrue per eligible card purchased, regardless of how many separate orders you place in a day.

8. Refunds/cancellations.

   If a qualifying purchase is cancelled or refunded, the associated stamp(s) will be deducted. If a refund occurs after you’ve received a reward code based on those stamps, we may, at our discretion, void the corresponding code, remove stamps from your balance, or apply a negative stamp balance to counteract the refund or cancellation.

9. Account deletion.

   Deleting your account permanently removes all accrued stamps and any unredeemed codes linked to that account.

e). New and Returning Customer

1. New Customers.

   If you are a new customer making your first purchase with Thortful and your purchase contains only one eligible item, you will qualify for a reward code after your second eligible purchase. This code can be redeemed at the value of a standard A5 card (delivery not included) and will be available for use on your third qualifying purchase.

2. If your first transaction includes two or more eligible items, you will automatically move onto the 6th card free card reward structure instead.
3. All eligible purchases made in that first transaction will be added to your loyalty stamp balance at whichever stage you enter the thortful Loyalty Programme (“rewardful”).
4. Once a new customer has claimed their 3rd card free, any eligible purchases made prior to that claim will Note: count towards their 6th card free.
5. Returning Customers.

   Returning customers will always work towards their 6th card free reward. However, we will load any eligible past purchases (up to a maximum of 3 stamps) made within 365 days prior to the thortful Loyalty Programme (“rewardful”) launch date onto your loyalty stamp card, provided they meet the eligibility s criteria set out in these Terms and Conditions.

6. Definition of New Customer

   For the purpose of these Terms and Conditions, a “new customer” means an individual who has not previously completed a purchase on the Thortful website or app using their account. Customers who create multiple accounts, or attempt to re-register to be treated as “new” will not be eligible for new customer rewards.

f). Rewards: Issuance & Limits

1. After collecting 5 stamps, you will earn one reward code redeemable for a standard A5 card (delivery not included). The reward code may also be used towards a Photocard, a Face Swap card, or the card element of a Card Gift. In such cases, the code will be applied up to the value of a standard A5 card, and you will be responsible for paying any price difference at checkout where the selected product is priced higher than a s standard A5 card. The rules for the 3rd card free and 6th card free rewards are set out in clause 5.
2. We’ll email your reward code to the email address on your account by midday on the next day after you earn your 5th qualifying stamp. Check spam/junk; if you can’t find it, contact us.
3. There is no annual limit: every 5 stamps = 1 reward code. If you earn multiple rewards in one order (e.g., 10+ cards), we’ll send all relevant codes together in one email. Rewards earned at different times will be emailed separately.
4. Unless stated otherwise, reward codes expire after 365 days from the day they are issued.
5. If the stated reward (the value of a free standard A5 card) becomes unavailable, we may substitute it with an item of equal or greater value at our discretion.

g). Using Your Reward Code

1. Validity.

   Each reward code is valid for the value of one free standard A5 card. The code may also be applied towards any card type, i.e. Photocard or Face Swap card, in which case it will cover the value of a Note: standard A5 card, and you will be required to pay any price difference at checkout. The value of the card element within a Card Gift will also be covered by the reward code, with any remaining value payable by you. Delivery charges and any extras (e.g., tracked shipping) are payable by you.

2. Exclusions.

   Reward codes may be applied to any product available on the Thortful site. However, the code will only April cover the value of a standard A5 card. If you choose an item priced higher than a standard A5 card (for example, an A4 card, a Card Gift, flowers, or other products), you will be responsible for paying the difference at checkout. Delivery charges and any extras remain payable by you.

3. Combinability.

   One code per transaction. Reward codes cannot be combined or stacked with other codes/offers.

4. Personalisation. Example

   Reward codes can be used on personalised cards, Photo Cards, Face Swap cards, or the card element of a Card Gift, provided the card selected is a standard A5. Where the chosen product is priced higher than a standard A5 card (for example, Photo Cards or Face Swap cards), the reward code will cover the value of a standard A5 card, with any remaining value payable by you.

5. Occasions & scheduling. Example

   Reward codes can be used during peak occasions and on scheduled orders or reminders, provided you apply the code at checkout.

6. App & international.

   Codes can be redeemed on the thortful app and for international delivery (delivery charges apply).

7. Basket with additional items. I

   If your order includes other items alongside your standard A5 card, the reward code will apply to one eligible A5 card only. If you’ve added more than one standard A5 card, the discount will be automatically applied to one; you will not be able to choose which. All other items and delivery will be charged at the s applicable price.

8. One-time use. Note:

   Each code is single-use and becomes invalid once redeemed (even if the order is later cancelled for reasons outside our control).

h) Visibility of Stamps

1. We will email you when you earn a reward. A stamp tracker in your account may be introduced in future; until then, progress communications may be provided in our emails.

9. Errors, Abuse & Fair Use

1. We may withhold, revoke, adjust, or suspend stamps/rewards if we reasonably suspect fraud, abuse, error, or s breach of these Terms and Conditions (e.g., multiple accounts, automated ordering, resale activity). We may also suspend or close your account if we reasonably believe you are abusing the thortful Loyalty Programme (“rewardful”), engaging in business use, or otherwise acting in a way detrimental to THORTFUL LIMITED.
2. We may correct any obvious errors (pricing, attribution of stamps, or reward issuance) and will notify you if we do.
3. Any misuse of the Thortful site or technical interference in connection with the thortful Loyalty Programme (“rewardful”) may result in removal from rewardful and/or closure of your Account.

i) Customer Support

1. If your reward email/code doesn’t arrive or doesn’t work, first check spam/junk, then contact [email protected]
2. If a valid code failed to apply at checkout, contact us; we’ll review and may reissue or apply a remedy at our discretion.

j) Unsubscribing, Pausing & Leaving

1. If you unsubscribe from Loyalty Communications (“rewardful”), you’ll stop collecting new stamps and won’t receive reward codes.
2. Any reward codes already issued will remain valid (subject to these Terms and Conditions). Any stamps already A earned will remain in your account for 365 days, but you will not earn new stamps while unsubscribed.
3. You can resubscribe at any time to begin collecting stamps again (potential stamps earned while unsubscribed will not be retroactively added).
4. Deleting your account removes all stamps and any unredeemed codes.

k) Data & Privacy

1. We process your personal data to operate the thortful Loyalty Programme (“rewardful”), (e.g., tracking stamps, sending reward codes) in line with our Privacy Policy.
2. Loyalty Communications (“rewardful”) are necessary to administer the thortful Loyalty Programme This (“rewardful”). Marketing communications are optional and based on your separate consent. You can change preferences at any time via the links in our emails.
3. We may also use data about your participation in the thortful Loyalty Programme (“rewardful”) to analyse trends and improve our services, in line with our Privacy Policy.
4. Your loyalty participation status may be stored using essential cookies. For more details, see our Cookies s Policy.

l) Liability

1. The thortful Loyalty Programme (“rewardful”) and rewards are provided “as available”; we do not guarantee Section continuous availability of emails or third-party services (e.g., email providers, app stores).
2. The thortful Loyalty Programme (“rewardful”) is provided in connection with the Thortful website. Our liability in relation to the thortful Loyalty Programme (“rewardful”), including the use of reward codes, is governed by our Website Terms of Use, which take precedence over these Loyalty Programme (“rewardful”) Terms and Conditions.
3. Reward codes are redeemed against products purchased through the Thortful site. Any issues relating to section faulty or defective products or non-delivery will be handled under our Website Terms of Use.

m) Suspension, Variation & Termination

1. We may change these Terms & Conditions, the earning rules, or rewards (including adding an expiry period for future codes) to reflect operational, commercial, legal, or security reasons.

2. For material changes that negatively impact you, we will provide reasonable notice (e.g., 14 days) where practicable.
3. We may suspend or end the thortful Loyalty Programme (“rewardful”) on reasonable notice. If ended, we’ll honour valid codes already issued or provide a reasonable alternative. Stamps that have not yet reached a reward threshold will lapse if the thortful Loyalty Programme (“rewardful”) ends, unless we state otherwise.

4. We may transfer our rights and obligations under this Loyalty Programme (“rewardful”) to another organisation (e.g., if we are sold or merged) without affecting your rights.
5. It is your responsibility to review these Terms and Conditions from time to time. By continuing to participate in the thortful Loyalty Programme (“rewardful”), you agree to be bound by the latest version.

1. If you’re unhappy with any aspect of the thortful Loyalty Programme (“rewardful”), contact [email protected]. We’ll try to resolve your concern promptly.
2. If you remain dissatisfied, you may also seek advice or escalate to Trading Standards or other consumer protection bodies.

o) Governing Law

1. These Terms and Conditions are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction.
2. All purchases made as part of the thortful Loyalty Programme (“rewardful”) remain subject to applicable UK laws.

17. Competition Terms

1. From time to time, Thortful may run competitions, prize draws, or promotions linked to the thortful Loyalty Programme (“rewardful”), (“Competitions”). Participation is subject to these thortful Loyalty Programme s (“rewardful”) Terms and any additional rules published for each Competition (“Specific Rules”), which take precedence in case of conflict.
2. Competitions are open to customers who hold a valid Thortful Account that is opted in to Loyalty As Communications (“rewardful”) and are aged 16 years or over, unless stated otherwise in the Specific Rules. Employees of Thortful, their immediate families, or anyone professionally connected to the Competition are not eligible.
3. Entries must follow the method and deadline outlined in the Specific Rules. Late, incomplete, or ineligible entries will not be accepted. Winners will be selected as specified (e.g. random draw or judged entry), and s our decision is final.
4. Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash or alternatives. We may substitute a prize of equal or greater value if necessary. Winners will be contacted via the details on their Such Thortful account unless otherwise stated. If a winner does not respond within 14 days (or the timeframe specified), we reserve the right to withdraw the prize and select another winner.

5. By entering, you consent to reasonable publicity use of your name and (if applicable) winning entry, unless you opt out. We reserve the right to amend, cancel, or withdraw a Competition due to circumstances beyond our control.
6. Thortful’s liability in relation to Competitions is outlined in clause 13 of these Terms and our Website s Terms of Use. Personal data will be handled in accordance with our Privacy Policy.

11) COMPETITION TERMS

By entering our competition, you agree to us collecting and using your personal data for the purposes of administering the competition, including contacting the winner. Your data will be handled in accordance with our Privacy Policy. We will not share or sell your information to third parties.

Creator Terms

These Creator Terms apply to the uploading and sale of content and other use of the thortful website and mobile applications (together the thortful sites) by our creators. If you are a customer wishing to purchase cards or other products from the thortful sites, please see our Customer Terms (above). By accessing a thortful site and/or placing an order you agree to be bound by these Creator Terms. If you do not agree to be bound by these Creator Terms, you may not use or access the thortful sites.

2) CREATOR ACCOUNT

We provide services (referred to in these terms as our Services) which are primarily designed to help creatives share and offer cards for sale, and to enable buyers to purchase those products.

To use our Services as a creator you must open an account on the thortful site via email or via Facebook, Apple id (for iOS app) or Google account (for Android app) giving your name and email address and creating a creator profile. Your details must be complete, correct and true. Where you provide us with a photo and other information in your bio or creator profile, you acknowledge that we may make that photo and information available to the public via the thortful sites.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party.

In order to hold a creator account you must actively participate in our Services at least once every 365 days.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at [email protected].

3) UPLOADING CONTENT TO THE THORTFUL SITE

Whenever you upload content to the thortful sites, make content available via our Services or make contact with users on the thortful sites (together referred to as your Content), you must comply with the content standards and creator conduct obligations as set out below. You warrant that all of your Content does and will comply with those standards and obligations.

We make your Content available on the thortful sites at our sole discretion. If we consider that a design is not up to the standard which we require, it will only be available for users to purchase from your profile page, and will not appear in the occasion categories or any search results. We reserve the right to delete, move, and edit your Content for any reason, at any time, without notice and without liability to you.

We will not be responsible or liable to you or to any third party for your Content. You will be responsible and liable to us, to our customers and to third parties for your Content and you are solely responsible for securing and backing up your own copies of your Content.

4) EXCLUSIVE CONTENT SCHEME

We value content which is exclusive to thortful and offer exclusivity benefits to creators who offer content for sale exclusively via the thortful sites.

As part of the upload process you are asked to state if your designs are ‘exclusive’ to thortful. If the imagery, caption or content is the same or substantially similar to a design sold or licensed by other online retailers or print on demand companies, then it cannot be classed as exclusive. This does not currently include designs sold by you on your own website or sold by you via online marketplaces Etsy and Not on the Highstreet.

By confirming that your design is exclusive to thortful, you will be responsible for ensuring that this information is up to date and correct at all times. Should we find that this is not the case, we reserve the right to remove the exclusivity benefits and in certain circumstances we may terminate your creator account and remove your creator profile and your Content from the thortful sites.

We reserve the right to terminate or change the terms of our exclusive content scheme (including what constitutes ‘exclusive’ content) and the exclusivity benefits at any time at our sole discretion.

5) COPYRIGHT AND OTHER INTELLECTUAL PROPERTY

Your Content
You retain all of your ownership rights in your Content but by uploading your Content or otherwise making your Content available for promotion and sale via the thortful sites, you grant us a worldwide, non-exclusive, sub-licensable, transferrable licence to store, reproduce, crop, frame, modify, copy, distribute, prepare derivative works of, display, make available to third parties and otherwise use your Content in connection with:

• the promotion and sale of products including but not limited to greeting cards, sock cards, cake cards, chocolate cards, chocolate selection card, notebooks and any other products of any nature which we make available for sale from time to time via the thortful sites or any other platforms under the thortful brand (including but not limited to Amazon);
• the promotion of your logo/brand/personal imagery and location to inform customers/audience of the thortful marketplace brand story
• the operation of the thortful sites and our Services; and
• the promotion of thortful’s business or any part of it in any medium and via any media.

We respect the intellectual property rights of others and we ask our customers and creators to do the same. You are responsible for your Content and for ensuring that you have the necessary rights to use your Content and to grant the licence described above. If we receive notice claiming that any of your Content infringes the rights of a third party, we may remove your Content from sale without notice and you will be liable to us for any loss suffered as a result of such infringing content.

Thortful sites and other content
We are the owner or the licensee of all intellectual property rights in the thortful sites and the content. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may only use the thortful sites for lawful purposes and you may not use it in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of the thortful sites.

You must not, without our prior written consent, copy, reproduce, crawl, frame, republish, download, print, post, distribute, re-post, broadcast, record, transmit, edit, communicate to the public, link to, deep-link into, or distribute in any way the web pages or materials on the thortful sites other than solely for your own personal use. Our status, and that of any identified creators, as the authors of material on the thortful sites must always be acknowledged.

IP Infringement Policy
If you are aware that any of your intellectual property rights have been infringed by any product offered for sale on the thortful sites, please contact us via email ([email protected] and provide us with the following information:

• identification of the copyrighted work claimed to have been infringed;
• identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
• your contact information, including your address, telephone number, and an email address;
• a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law; and
• a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

Where we receive notice of an infringing product we will liaise with the relevant creator (which may include passing on the information you provide) to ensure that the infringing product is removed from sale.

6) CONTENT STANDARDS AND CREATOR CONDUCT

You must not use the thortful sites to upload, distribute or share any prohibited content including but not limited to the following:

• copyrighted material used without the express permission of the owner or which otherwise infringes the intellectual property rights of any third party;
• material that violates the rights of others;
• material that contains viruses, worms, trojan horses or other forms of corruptive code, or any other content that may compromise the thortful sites;
• material that advocates illegal activity;
• material we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate;
• material that, in any way, is harmful to minors;
• material which is in breach of any applicable laws, rules or regulations;
• material that provides a link to any of the above; or
• material which is otherwise in breach of these Creator Terms.

You warrant that your Content complies with the standards set out above. We have the sole discretion to determine whether content is prohibited content, and we may examine content submitted to the thortful sites from time to time. We do not monitor or control the content posted to the thortful sites and we do not take responsibility for such content. However, we may delete, move, and edit content for any reason, at any time, without notice.

If you have reason to believe at any time that your Content does not comply with the content standards set out above, you must let us know by contacting us at [email protected] and you must immediately remove the offending content from the thortful sites.

7) CREATOR PAYMENT

Where we sell products which feature your Content, your creator account will be credited with a royalty amount based on the net sales value (being the amount which we receive for the product, minus VAT). The royalty amounts for each product are shown below. Different royalty amounts will apply depending on whether the creator signed up before or after 1st September 2017:

Royalty amount for products sold at full retail price (Creators who signed up on or after 1st September 2017):

A4: £0.40
A5: £0.32
A6 pack: £0.40

Royalty amount for products sold at full retail price (Creators who signed up prior to 1st September 2017 and have continuously held a Thortful account since that date):

A4: £0.60
A5: £0.42
A6 pack: £0.60

Any special rates or amounts are to be agreed with Creators on an individual basis outside of the outlined terms.

The royalty amounts detailed above are based on products sold at full retail price. The royalty amount received for each product sold will be adjusted according to the net sales price; where a product is sold at a discounted rate, the royalty amount will incur the same discounted rate. Where royalties for Gift and Card Gift sales have previously been displayed separately, they are now displayed grouped with royalties of the card that accompanies the Gifts or Card Gifts purchased. Where we launch new products which feature your Content we will update these terms with the new royalty amounts which apply to those new products. We reserve the right to adjust the royalty amounts at any time at our discretion. Royalties are paid at the end of the month following the month in which they are earned. It is essential that creators have their own Paypal account as this is the only way through which royalties can be paid. To receive your royalty payments you must enter your PayPal payment details and Invoice details via the Creator’s details page of your creator account, which can be accessed by clicking on your name in the top right of the page, and going to the Creators section. thortful cannot be held liable for any payments outstanding due to missing information. Due to Paypal fees the minimum monthly royalty payment we make is £5, however if you don’t make this total one month then your royalties roll over to the next month. In the event that we pay a refund to a customer or provide a form of equivalent compensation for any reason, we reserve the right to cancel or reclaim the related royalty payment from you. If a payment remains unclaimed after 30 days it gets returned to us by PayPal. thortful will not be liable for any payments which are unclaimed, due to an incorrect PayPal email being added to an account or for any other reason. We will resend the returned payment with the next scheduled payment. Unclaimed funds will remain pending on a creator’s account until a valid PayPal email is added, or for the duration of one calendar year. If, after this time, a payment is still outstanding, the royalties will be forfeited and any payment due will be cancelled. We consider a creator buying their own card as them ordering a sample. As a result, no royalty is paid on this sale. Creators are asked to get in contact with the team [email protected] before they order the sample in order for us to help them with the process.

8) TAXATION RESPONSIBILITY

You are responsible for your own taxes associated with the royalties earned and you must account for any taxes imposed by governments or governing authorities.

thortful will not collect or pay taxes on your behalf. The royalty amounts paid to you will be deemed to be inclusive of any taxes. You will at all times be solely responsible for reporting and remitting any tax liabilities arising out of the sale of products featuring your Content together with any potential interest or penalties that any tax authority may levy as a result of non-compliance.

If you are registered for VAT in the UK thortful will pay VAT relevant to the royalties earned when a valid UK VAT certificate is uploaded to your creator’s account. This can be done by clicking on your name in the top right-hand corner of the page and going to Creators > VAT. thortful will provide you with a VAT invoice for any royalty payments made. This can be downloaded from Payouts page (click on your name in the top right-hand corner of the page and go to Creators > Payouts).

For the avoidance of doubt, all tax-related reporting responsibilities by you to relevant tax authorities are entirely your responsibility, and thortful will not be liable for paying any tax owed on your behalf.

9) YOUR LIABILITY

You are responsible for your Content and your compliance with these Creator Terms. You agree to indemnify, defend and hold us, our officers, directors, employees, subcontractors, agents and representatives harmless from and against any and all claims, damages, losses, liabilities, costs (including reasonable legal fees) or other expenses of whatever nature that arise directly or indirectly out of or from any of the following:

• your breach of any provision in these Creator Terms;
• any claim from a third party relating to your Content;
• any allegation that your Content or any materials that you submit to us or transmit to or via the thortful sites infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property rights or other rights of any third party;
• your activities in connection with the thortful sites and our Services.

The above indemnity will apply without regard to the negligence of any party, including any indemnified person and will survive termination of your creator account however occurring.

10) TERMINATION

We reserve the right to disable or terminate at any time, in full or in part and without further notice, your creator account and your right to use our Services, and to remove and discard your Content for any reason. In particular but without limitation we have the right to disable or terminate your creator account and your use of our Services at any time, if in our reasonable opinion: (a) you have failed actively participate in our Services for a period of 365 days; (b) you have failed to comply with any or all of the provisions of these Creator Terms; (c) you have violated any other applicable regulations, guidelines or laws; (d) your conduct is harmful or detrimental to thortful or other thortful users, our services or any third parties; or (e) you have not accessed your account for a prolonged period of time.

You have the right to close your creator account and terminate your use of our Services at any time by contacting us at [email protected].

In the event that your creator account and use of our Services is disabled or terminated for any reason, you will no longer be able to log into your creator account and your creator profile will be removed from the thortful sites. a) Changes To These Terms

These Creator Terms may be changed or updated by us at any time without notice. We recommend that you check these Creator Terms periodically for any updates we might make from time to time, as they will be binding on you.

We may update the thortful sites from time to time, and may change the content at any time. If the need arises, we may suspend access to the thortful sites, or close them indefinitely. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

j) Jurisdiction and applicable law

These Creator Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales
